According to the German Federal Data Protection Act (Bundesdatenschutzgesetz, abbr. BDSG) § 4g paragraph 2, Agosi’s data security officer provides the following information with regard to § 4e to whom it may concern:

Data material is deleted routinely after the expiry date of the legally defined duration for data storage. Data not included in these intervals will be deleted after having fulfilled their purpose(s) as defined under 5.

The websites www.agosi.de and www.agosishop.de (jointly referred to below as “website”) are operated by Allgemeine Gold- und Silberscheideanstalt AG (referred to below as “Agosi” or “we”), Kanzlerstr. 17, 75175 Pforzheim as responsible party within the meaning of the German Federal Data Protection Act [BDSG].

The protection of your private sphere and your personal data is very important to us. Agosi uses your personal data solely in accordance with prevailing data protection legislation.

We would like to explain to you below which personal data we collect during your visit to our website and how this data is used.  Please note that this privacy policy does not extend to websites of other operators which may be accessed through external links.

1. Collection and processing of personal data

The term “personal data” refers to all individual details about the personal or factual relationships of a specified or specifiable natural person. This includes information such as your name, your address or your telephone number.

Personal data does not include information of a purely statistical nature which cannot be associated with you, such as the number of users of a website.

In operating this website, we collect the following personal data:

1.1 Usage data automatically collected upon visiting our website

Unless you provide us with information when using the website, for example by signing in, registering or by other means, we collect – in keeping with all other websites – only such data which is automatically transmitted by your browser in order to enable you to visit our website. This usage data is documented in a “logfile”. It consists of the following data:

  • IP address (Internet Protocol address) of the computer from which you are accessing our website;

  • name of files or information retrieved;
  • date, time and duration of retrieval;
  • volume of data transferred;

For security reasons (e.g. in order to identify hacker attacks), IP addresses or logfile information of the type described above are stored by Agosi for a maximum of seven days and then deleted (unless it is necessary and permissible in individual cases to store data for longer periods).

1.2 Personal data collected by our online store

We collect, store, process and use the personal data provided by you when setting up a user account or placing an order for the purposes of creating, implementing and processing contracts entered into with us.

You can make online purchases as a guest or as a registered user. During this process we collect the following data:

  • first name and surname;
  • email address;
  • postal address;
  • telephone number;
  • payment information and/or bank account details;
  • dispatch information (such as invoice and delivery address);
  • a password selected by you (only in the case of a user account).

1.3 Other personal data

In addition to the usage data set out above, we collect and process personal data which you make available to us, for example if you contact us by email or take part in surveys or prize draws. In particular, the following personal data may be collected:

  • first name and surname;
  • postal address data if relevant;
  • email address;
  • content of your messages to us;
  • status of any permissions (e.g. in connection with newsletters).

 2. Purpose for which the personal data is used

Apart from the purposes set out above, Agosi uses your personal data for the following purposes (only to the extent required for the respective purpose):

  • provision of the website and technical administration of the website;
  • prevention of misuse/fraud;
  • customer management and performing online sales;
  • own and third-party advertising to the extent permitted by law; and for
  • improving our Internet offering.

3. Disclosure of data to third parties; involvement of service providers

Personal data of website users and of our online customers will as a matter of principle only be disclosed to third parties if this is necessary in order to process the contract (for example payment service providers) or if consent has been expressly given.

However, Agosi may also engage service providers (who are not third parties within the meaning of data protection law) to collect and/or process and use personal data. As commissioned data processors, these service providers are then contractually obliged to process data solely for the purposes specified by Agosi (and not for other purposes of their own) and as instructed by Agosi (Agosi has concluded suitable commissioned data processing contracts with all commissioned data processors in order to ensure this).

Service providers only receive from Agosi the personal data they need for the specific task concerned. For example, email addresses may be disclosed to a service provider so that the service provider can deliver the Agosi newsletter. Service providers may also be entrusted to provide computer centre services (within the EU), to analyse the user-friendliness of our website or to provide technical support.

In this respect, it is important for us to stress that service providers may not disclose your data to any third parties without the consent of Agosi (or its subcontractors). Furthermore, no personal data may be transmitted to authorities or other state institutions except to the extent permitted under data protection law and as required by binding national legislation.

4. Cookies and similar technologies

The website uses “cookies” in order to make it as easy as possible for you to use the website. Cookies are text files transmitted via the Internet browser when the service is called up. Cookies are automatically stored on your device. Cookies help us to make this Internet service more user-friendly. 5. Use of the Google Analytics web analytics service

The website uses Google Analytics, a web analytics service provided by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA, “Google”). Google Analytics uses cookies (see section 4 above), which are stored on your device and which enable your use of the website to be analysed. The information generated by the cookies about your use of this website is generally transmitted to and stored on a Google server in the United States.

On behalf of Agosi, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services for Agosi relating to website activity and Internet usage. Google will not associate the IP address of your Internet browser transmitted in the context of Google Analytics with any other data held by Google, but will anonymise it by truncating the IP address. (In the context of this website, Google Analytics has been extended by the code “gat._anonymizeIp()” in order to guarantee the anonymous collection of IP addresses (“IP masking”)). Furthermore, the data collected by Google Analytics will not be used by Agosi to personally identify visitors to this website nor associated with personal data. In addition, you also have the right to have this personal data corrected, blocked and deleted in accordance with prevailing legislation.

On request, we will inform you as quickly as possible in writing and in accordance with prevailing legislation whether and which personal data about you is stored by us. If, in spite of our efforts to ensure that data is correct and up to date, any incorrect information is stored, we will correct this at your request.

7. Consent

Inasmuch as we collect and process data on the basis of your consent, we will inform you of this separately from this privacy policy and obtain consent from you separately (e.g. in connection with direct marketing). You may withdraw your consent to the storage and processing of your personal data at any time. In this case, please contact our customer service by sending an email to info@agosi.de.

8. Data security

Our website is SSL encoded. All data at Agosi are stored on servers in a German computing centre. Agosi and its computing centre service provider undertake all technical and organisational measures required by law to protect your data in accordance with the general state of the art, in particular from lost, forgery or access by unauthorised persons.

In case you would like to contact us by email, we hereby point out that the confidentiality of the information transmitted cannot be guaranteed. The content of emails may as a matter of course be subject to spy attacks by unauthorised third parties during transmission

9. Changes to the privacy policy

Agosi reserves the right to update this privacy policy at any time without notice (this may become necessary, for example, as a result of recent developments such as an amendment to the German Federal Data Protection Act [BDSG] or in the event of our website being updated).
